Terms of Service

These terms govern your use of Curva, a WhatsApp-based ordering and delivery service operated by ANIGRAM NIGERIA LIMITED ("Curva", "we", "us", or "our"). By placing an order through Curva, you agree to these terms. Please read them alongside our Privacy Policy and Refund Policy.

1. What Curva is

Curva lets you order groceries, meals, medication, and everyday essentials from participating stores in Lagos through a single WhatsApp chat. When you tell us what you need, we find the items across nearby stores, take payment, arrange for the stores to prepare the order, and dispatch a rider to deliver it to you.

Curva acts as a marketplace and coordination service. The stores you order from are independent businesses. Curva is responsible for coordinating your order, taking payment, and arranging delivery; the participating stores are responsible for the goods they supply.

2. Placing an order

• You place orders by messaging our WhatsApp number and describing what you need, in text or as a voice note.
• We will show you a cart with the items found, the price of the goods, and any delivery and service fees before you pay. Nothing is charged until you confirm.
• Prices for goods are set by the participating stores and may change. The price shown in your cart at the time you confirm is the price that applies to that order.
• An order is only accepted once payment is confirmed and the relevant store has accepted its part of the order.

3. Payment and fees

Payment is taken securely through our licensed payment processors within the WhatsApp chat. Your order total is made up of:

• The cost of the goods, as set by the participating stores.
• A delivery fee, which covers dispatching a rider to collect and deliver your order. Orders collected from more than one store may carry an additional delivery amount, which is shown in your cart before you pay.
• A service fee, which covers running the Curva service. This is shown in your cart before you pay.

All fees applicable to an order are displayed in your cart before you confirm. There are no hidden charges.

4. Availability and substitutions

Occasionally a store may not have an item in stock when it comes to prepare your order. If that happens, the affected item is cancelled and refunded, and the rest of your order proceeds. If an entire store's portion of your order cannot be fulfilled, that portion is cancelled and refunded. We describe exactly how refunds work in these situations in our Refund Policy.

We do not substitute items for different ones without your agreement. Where a choice needs to be made, we will ask you in the chat.

5. Delivery

• We deliver within our published coverage areas in Lagos. If your delivery address falls outside these areas, we will let you know before you pay.
• Delivery times are estimates and may be affected by traffic, weather, store preparation times, and other factors outside our control.
• Someone should be available to receive the order at the delivery address. If our rider cannot reach you or hand over the order after reasonable attempts, the order may be returned, and refunds are handled as described in our Refund Policy.

6. Your responsibilities

When you use Curva, you agree to:

• Provide accurate order, contact, and delivery information.
• Be old enough, under Nigerian law, to purchase the items you order, including any age-restricted goods.
• Use the service lawfully and not for any fraudulent, abusive, or unlawful purpose.
• Treat our staff and delivery riders with respect.

We may decline or cancel orders, and may suspend access to the service, where we reasonably believe it is being misused.

7. Medication and age-restricted items

Orders for pharmacy items are fulfilled by licensed pharmacy partners and may be subject to their professional requirements, including declining to supply certain items. Age-restricted items are supplied only where permitted by law and may require verification.

8. Liability

The participating stores are responsible for the quality, safety, and description of the goods they supply. Where an issue arises with the goods themselves, we will help you resolve it with the relevant store and process any refund due under our Refund Policy.

To the extent permitted by Nigerian law, Curva is not liable for indirect or consequential losses, or for delays or failures caused by events outside our reasonable control. Nothing in these terms limits any rights you have that cannot be excluded under applicable law.

9. Changes to these terms

We may update these terms from time to time. When we do, we will update the effective date at the top of this page. Continuing to use Curva after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and any disputes are subject to the jurisdiction of the Nigerian courts.
